Terms of Service

1. Agreement

These Terms govern your access to and use of LumaHAUS, an AI-powered photo enhancement service operated in Canada. By creating an account or using the service, you agree to these Terms.

2. Accounts

You must provide accurate account information and keep your login credentials secure. You are responsible for activity under your account and for ensuring that invited team members use LumaHAUS lawfully.

3. Your images and rights

You retain all rights you hold in photographs and other material you upload, as well as your rights in finished images created for you through LumaHAUS. LumaHAUS does not claim ownership of your content.

You grant LumaHAUS a limited, non-exclusive permission to host, copy, transmit, and process your content only as needed to provide, secure, maintain, and improve the service. You represent that you have the rights and permissions needed to upload and process each image.

4. Commercial use

You may use finished images commercially, including in real estate listings, client galleries, marketing, architecture, design, and hospitality work, provided you have the necessary rights to the source images and your use complies with applicable law and these Terms.

5. AI-generated results

LumaHAUS uses automated systems to alter lighting, atmosphere, colour, and mood. Results may vary and can introduce visual changes or inaccuracies. You are responsible for reviewing finished images before publication and for complying with any disclosure, advertising, real estate, or professional rules that apply to your work.

6. Credits, payments, and refunds

One photo credit is used for one photo relight. New accounts receive 10 complimentary credits. Purchased credits roll over and do not expire. Prices and applicable taxes are shown before purchase. Failed processing attempts are automatically credited back where indicated by the service.

Except where required by law or where LumaHAUS expressly states otherwise, completed credit purchases are final. Payment processing may be provided by third-party payment providers under their own terms.

7. Acceptable use

You may not use LumaHAUS to violate law, infringe another person’s rights, upload content you are not authorized to process, distribute harmful code, interfere with the service, or attempt to bypass account, payment, credit, or security controls.

8. Service availability

We work to keep LumaHAUS available and reliable, but processing times and availability may vary. We may update, suspend, or discontinue parts of the service. Features that depend on third-party services may also be affected by those providers.

9. Disclaimers and liability

The service is provided on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee a particular creative, business, listing, or financial outcome. To the extent permitted by law, LumaHAUS is not liable for indirect, incidental, special, consequential, or lost-profit damages arising from use of the service.

10. Termination

You may stop using LumaHAUS at any time. We may restrict or terminate access where an account violates these Terms, creates risk for the service or others, or where required by law.

11. Governing law

These Terms are governed by the applicable laws of Canada, without regard to conflict-of-law principles. Mandatory consumer protections that apply in your place of residence remain unaffected.
